Spousal support, often called alimony, plays a significant role in many divorces. Whether you’re seeking support or being asked to provide it, understanding how spousal support works in Michigan is crucial. At Tabono Law, our experienced family law team is here to guide you through every step of this process, ensuring your rights are protected and your interests represented.

What Is Spousal Support
Spousal support is a financial arrangement in which one spouse provides monetary assistance to the other during or after a divorce. In Michigan, spousal support is not automatically granted but is determined based on the specific circumstances of each case.
Courts consider several factors, including:
How did each party treat the other during the marriage?
The length of the marriage;
- How long both parties have worked and can probably continue to work?
- Any disabilities preventing a party from working?
- How long has a party been out of the workforce and reason?
- Special qualifications, education, specialized skills?
- Have parties attempted to secure employment?
The parties’ ages
If a party may be seeking spousal support, we look to see how much discretionary income the opposing party has. We will look at the other party’s budget and income.
- What does the standard of living look like for the parties?
- How are the parties accustomed to living? Overlaps somewhat with #10.
What needs will each party have given their age, health, and ability to work?
- Any major health issues with either party?
- Costs of health insurance?
If there will be dependents for either party; were there vacations; what kind of household expenses; types of cars driven; house bought.
- How did each party contribute during the marriage?
- Was it a financial contribution?
- Was it maintaining the household?
- Length of contributions?
Was either party at fault for the breakdown of the marriage? Affair, gambling, substance abuse, verbal/physical abuse, etc.
Is either party currently living with any other adult?
The attorney will cover this with the client. Basically, what is fair.
The goal is to ensure fairness and financial stability for both parties, but achieving the right balance often requires skilled legal representation.
